Terms and Conditions 

1.      You, the advertiser, warrant that you have the right to use the images, copy, computer files and PDF documents you have supplied to David Venish T/A Stepthru (hereinafter referred to as “the publisher) for inclusion in the ACT CD Rom Wedding Guide compact computer (hereinafter referred to as “the service”).

2.     You further agree by completing the Advertising Agreement that you will indemnify the publisher against any damages and costs that may be awarded against the publisher and / or any expenses incurred by the publisher with respect to any claims or action that the images, copy, computer files and PDF documents you supply for inclusion in ACT CD Rom Wedding Guide infringes the patent, copyright, registered design, trade mark, trade name, or other intellectual property rights of a third party or that the services infringe any other laws, or by-laws.

3.      You agree the images, copy and documents you supply for inclusion in the service shall not defame, threaten or otherwise violate the legal rights of others. In addition you warrant that images, copy and documents you supply for inclusion in the service shall not contain obscene, indecent or unlawful material.

4.      These terms and conditions shall be construed in accordance with the Law of New South Wales and that any proceeding in respect of any dispute arising out of these terms and conditions or the service must be commenced in the Courts of New South Wales.

5.       You agree that the publishers’ liability in the event of any breach or failure to perform in terms of the agreement between you and the publisher is hereby limited to an amount which shall not exceed the amount charged by the publisher for providing the service.

6.      You further agree that the publisher will not be liable for any special, consequential or incidental loss or damage or for any indirect loss or damage including without limitation to the forgoing, exemplary or punitive damages to property, loss of profits, or damages to personal property, even if the publisher is informed of the possibility of such damages.

7.      You agree that no joint venture, partnership, employment, or agency relationship exists between you and the publisher as a result of this agreement.

8.      The publisher reserves the right to refuse to accept an advertisement, and to refuse to renew an advertisement.

9.       The publisher reserves the right to change the terms, conditions, and notices under which the service is offered.

10.     I have read and accept these terms and conditions.
 

LIMIT OF LIABILITY / DISCLAIMER OF WARRANTY
